Muisca is the new Customs IT platform. The new regulations establish that all key data must be entered to Muisca at least 24 running hours (HBL) prior to the vessel arrival at dock; this also applies to import flights that must be announced directly by the airlines. 36 hours prior to arrival
The above implies for the origin station to keep close follow up on their pre-advises so that the destination office can comply with the required timeframes, which are set as minimums and the data can be entered in advance to those limits.
Important Notice:
- Applicable to Collect and Prepaid shipments alike.
- Keep in mind Colombian authorities do not accept neither Seawaybills nor Express Release as valid documents.
- Working hours in Colombia are: Monday through Friday, from 8:00 am to 5:30 pm.
Mandatory data required in the Shipping Documents:
The following information is required in the international transport documents (MAWB, HAWB, MBL y HBL) for all consignments destined to Colombia
• Provider’s details (name, address & phone number)
• Consignee’s Details (name, address & phone number)
• Importer’s RUT, which is the Colombian Tax ID (10 digits)
• Named place of dispatch for clearance: Bonded Warehouse or Free Zone User
• Port of origin
• Port of destination
• Type, number and date of shipping documents
• Features and characteristics of the Transport Contract, e.g.: Single contract, Multimodal, Combined, LCL, FCL, type of negotiation, etc.
• Complete and thorough descriptions of special cargo, e.g: Specific names of raw materials, Dangerous goods with UN number (this requires the name and contact data of the contact person at the shipper’s end), technical descriptions, etc.
• The freight cost as well as the corresponding ancillary charges (BAF, CAF, PSS, FSC, FSC, THC, BL Fee) must be stated in US Dollars – Colombian authorities will not accept any other currency.
• Container details: Number (letters and number digits), container tare, capacity, seal numbers, etc.
• Cargo descriptions e.g.: Agricultural Machinery spare parts, Automotive replacement parts, Textiles with composition charts, etc.
NOT accepted as proper descriptions:
Various goods, Goods as per invoice, Miscellaneous goods, General cargo, Dry cargo, Non-dangerous cargo, Merchandise as per records, Non-perishable goods, Merchandise for retail, etc.
• Harmonized Code (coded to up to 10 digits)
• Post –landing procedures such us:
- Delivery at named place of arrival or named bonded warehouse or named Free Zone User at port (coastal areas)
- On forwarding to named bonded warehouse or named Free Zone User in a non-coastal area, like Bogota, Cali or Medellin)
- Direct discharge
- Customs transit
- Urgent consignment
• Dimensions: Weight, volume, number of pieces, etc.
Important Notice: Consignee address must coincide with that of the actual place of arrival.
Impact:
• When a dispatch is consigned to a specific bonded warehouse or Free Zone for clearance, it will be the forwarders responsibility to cater for such on-carriage.
• We must observe the detailed level of data we require to include in the shipping documents.
• Origin stations must be aware of the Consignee’s Tax ID (10 digit RUT number).
• There must be no variations or discrepancies between MBL, HBL or HBL’s
• US dollars will be the only acceptable currency in the shipping documents.
Cornerstones
The cargo can be confiscated when:
• The cargo is brought in via a non authorized channel, point or port into the national territory.
• The carrier fails to provide the correct data on the cargo manifest, the amend documents valid for the customs authority before the arrival confirmation
• The cargo is covered only by documents not embedded in the cargo manifest or in its support documents.
• The cargo has been unloaded from a vessel/aircraft without a support shipping documents.
• The excess cargo has not been informed (number of pieces or the excess weight) with respect to the volume declared in the cargo manifest or the shipping documents not reflected in the cargo manifest.
• The cargo enters a warehouse presumably hidden in the transport means and which is not otherwise covered by the due transport documents.
Fines
• USD 5000 (20 SMLMV) per Shipment:
For hindering the control of the Customs Authority by concealing or purloin the goods being introduced in the national territory.
• 50% fine over the International Freight Value
a) Failure to enter the shipment data (that of the transport documents) to the established IT Platform (Muisca) in the established fashion and timelines.
b) Failure to report to the Colombian Customs & Treasury Department (DIAN) about the missing volumes/pieces or the excess in volumes or pieces discovered by the forwarder either on the documentation or physically on the cargo itself.
c) Failure to deliver the cargo at the named place (bonded warehouse or Free Zone) according to the established fashion and timelines.
d) Failure to hand in the support documents to justify the missing or excess volumes or pieces.
